    How soon can I apply for ILR and Naturalisation?

    Good day!

    I took my Life in the UK Exam last Thursday and thank God I passed! Yahoo!

    I also have an English certificate from Pearsons Academic which I used during my fiancee visa application. It is under the new approved test centre and I scored above the current requirement. Although it has expired, I read somewhere that I can use it for settlement. So, I think I am good with the requirements (Life in the UK and English).

    I arrived in the UK on a FIANCEE VISA - 21 November 2011.

    I got my FLR - 23 April 2012 and will expire on 23 April 2014.

    1. Can I apply for ILR in February 2014?
    2. How soon can I apply for Citizenship?
    3. I just had a baby, do I need to include her in my SET M Form? Or I don't need to because her father is a British citizen and she is not a subject to immigration control?
    4. My husband is also claiming Child Benefit for our daughter (Is that acceptable? Would it be a problem in my application?

    As long as your English Language passing grade/score meets the B1 level it's OK.
    Pearson scores for B1 are:-
    Listening – 36
    Speaking – 36

    No not February.
    The earliest you may apply is 28 days before your 2 year qualifying period living in UK as Spouse.
    In your case 28 days from 23 April 2014
    So the earliest date that your ILR application is allowed to be made is 26 March 2014

    In your case, as the spouse of a British citizen, you can apply for citizenship once you have completed at least 3 years living in the UK before your application is received by UKBA.
    This 3 year qualifying period can include the time you spent here as a fiancee.

    Before applying you must have ILR.
    There are also some residency requirements to be met:-
    - You spent no more than 270 days outside the UK during the 3 years qualifying period.
    - You spent no more than 90 days outside the UK during the last 12 months
    - You have not broken any immigration laws while in the UK

    That's right you do not need to include her as she is British Citizen.

    There is no problem at all that your husband is claiming Child benefit. He is entitled to claim any public funds/benefits that he is eligible for without any impact on your immigration status or ILR application.

    Hi msmaganda goodmorning. I am planning to take the Life in the UK Test soon. Did you used your account name or your husband account to pay for the Test? On my spouse visa I used my single name while on my bank account I used my married name. I am a bit confused which account do I need to use mine or my husband?

    It wont matter what a/c you use to pay, good luck with your test!
