    Worried

    Hi folks!
    Hope all is well.. I need your advice please,
    This morning we got a HMRC form a child tax credit form and makes me worried
    Because they put both our name my husband and my name
    So im worried since i am under immigration control and my ILR application will be next year, what do you think guyz is there any problem about my application if my name is in there as well in the form?

    Been a while. Hope all is good in life.

    Regarding your concerns about Child Tax Credit, please don't worry all is OK.
    Here's what UKBA formally state:-

    Child and working tax credits are claimed jointly by couples. If only one member of a couple is subject to immigration control, then for tax credits purposes, neither are treated as being subject to immigration control...
    So there's no problem at all.

    On another related aspect concerning Child benefit, just be sure that your husband is the named claimant and all will be OK on that also.

    Thank you for the helpful advice atleast i know now that nothing worry about so ill give it my signature in the form now
    Yeah its all my husband name even in the bank account its all his name.

    Sir peter, hope you're well! I am now too much worried again as my husband resign in work because he got a problem with his manager..
    My worries are he wanted to claim more benefits like job seeker's allowance? Is there any restriction to claim more benefits?since im under immigration control,we dont know what to do coz i dont want my ILR application next year at risk! Thank you

    Hi skysisi,

    Just to let you know that its not a problem that your husband claims JSA or any other benefits he is legally entitled to its only a problem if he claims more of a benefit because you live with him example if he claims for you as well.

    So the answer is he has full rights to claim as a single person not as a couple.

    You husband is perfectly allowed to claim and receive any benefits to which he is entitled.
    It will not impact your ILR
    Just be sure he is the named claimant.

    I stand to be corrected on this but sadly, I don't think he'll be able to claim Jobseekers if he resigned. Some of the rules about Jobseeker’s Allowance and payments at the end of a job are complicated.
    It's much better he will ask for detailed advice at a Citizens Advice Bureau. Sometimes the jobcentre make mistakes.

    If you left your job
    If you chose to leave your job, we’ll ask for the reason why. You
    need to show that you had a good reason for leaving. Your last
    employer may be asked to comment on any statement you
    make.
    Jobcentre Plus will make a decision based on a number of things,
    which include whether it was reasonable for you to take the
    action you did.
    If we decide that you left your job without good reason, you will
    lose your benefit for between 13 and 156 weeks (3 years)
