    Maternity Leave Entitlement?

    Hi All,

    After some advice.

    Just been reading through the uk.gov web site on the above subject, as my wife Ella meets all the criteria.
    The problem is, she is still on a spouse visa, so is she entitled to claim for pay while on maternity leave or will it adversely affect our ILR application?
    Ella has been here almost 2 years now, and been working for nearly that time.

    By the way, baby due in May.

    I'm pretty sure she's entitled to claim maternity pay (someone in the forum will correct me if I'm wrong). I'm currently on maternity leave and same as your wife still on spouse visa. I submitted my maternity leave and maternity claim to my employer and clearly stated in the form that I'm on spouse visa. I'm not entitled to claim maternity pay as I haven't work long enough for my employer.

    I'm also looking for advice about maternity pay... I have been working for a year with same employer. I think I am entitled to receive paid maternity leave for only 3 months from company. But as I'm still just holding spouse visa, am I also going to be able to receive the statutory maternity pay? And anyone knows how much it is? My passport/visa states that I am not to receive any fund from gov't or no recourse to public fund
