    Hiya all

    It's been a while!
    How's it going with you all?

    I've seen so many conflicting views on this matter???
    My wife has been here in the UK since Jan 2016.
    So would like to go back for a long holiday to see her family.
    How long can she stay out of the UK each year until she applies for the next part of her visa?

    Hmm ... you're right, Lloyd, there does appear to be conflicting views regarding this matter. And, in the absence of Terpe's expertise, ... ... I'd have been inclined to go along with Michael's 90 days' answer.

    According to the following link, however, it would seem there's NO limit to the number of days your wife can spend with her family in the Philippines, so long as she retains your UK address as her MAIN abode when extending her visas up until the stage of applying for Permanent Residence/ILR.

    N.B. Restrictions on time spent abroad, though, do come into play when a foreign spouse becomes eligible to apply for citizenship.

    So it seems to be there isn't anyone on this site that really who knows where I can find the correct answer to my question about how long can my wife can stay out of the UK without getting into trouble with the immigrations system?

    There's really no limit of how many days someone can be out of the country. Residency requirements is for someone applying for citizenship (Page 13 of https://www.gov.uk/government/upload...etion-v1.0.pdf). But most would take into consideration that UK must be their primary home, so they limit the number of days outside the country regardless of what visa type they hold. I think 90 days like what Arthur said is sufficient enough for someone to consider.

    Residence requirements: 6(2)
    The residence requirements which someone applying under section 6(2) of the British Nationality Act 1981 are that the applicant was:
    • in the UK at the beginning of the period of 3 years ending with the date of application
    • not absent from the UK for more than either: o 270 in that 3 year period
    o 90 days in the period of 12 months ending with the date of application

    • not, on the date of the application subject under the immigration laws to any restriction on the period of stay in the UK
