hi,
just wanna know if we can apply our daughter for citizenship, we're in UK now and we kinda want her to apply for citizenship since her dad is british citizen since birth.

if there any way, or she need to wait for 2 years to become british citizen like me?

coz in the phils you'll just need to register the birth cert and both parents should be there in person when passing it to the UK embassy.

just wondering if its applicable here too lol

The Child can have immediatly the Citizenship. It just have to be declared at the Embassy of the birth country with a full extract of the local birth certificate (NSO sepca one if birth was given in the Philippines). He will receive a British passport some weeks later. More than very useful (not to say mandatory...) to easily travel abroad.

hi thanks but you can only register the child birth cert in the phils if the father is present there too, when you pass the child BC at UK embassy.

our daughter is under join parent/parents in UK for settlement. i guess she will have to wait for 2 years for ILR then 1 year for naturalization before getting the british citizenship at all.

I'm sure your Daughter will not have to wait like you has she's British by her Father (she's not a foreigner as you, from a citizenship point of you).

But I don't know the process in UK for her to get a British citizenship in this specific case, others will help you here for sure. I just think taht by not declaring her first at the Embassy, you didn't choose the easiest way for her.

Married or not does not matter. What is important for the UK laws is if the British Father recognize it and have his name indicated on the birth certificate (for getting a British Citizenship under UK laws).

The main difference is that under Philippines laws (kid born in the Philipinnes having a Filipino Citizenship) if there is no marriage indicated on the Birth certificate, even if the Father's name is indicated, he has no right in the kid. The mother has the full autority alone.

Extracts of the Family code of the Phillipines (E.O. 209):
Art. 165. Children conceived and born outside a valid marriage are illegitimate, unless otherwise provided in this Code.
Art. 176. Illegitimate children shall use the surname and shall be under the parental authority of their mother, and shall be entitled to support in conformity with this Code. The legitime of each illegitimate child shall consist of one-half of the legitime of a legitimate child. Except for this modification, all other provisions in the Civil Code governing successional rights shall remain in force.

I'm afraid that you are incorrect - being married does matter if the child was born abroad before 1 July 2006. It also matters if the British parent is "British by descent" or "British otherwise by descent" .

Please read the citizenship pages from the UK Border & Immigration Agency.

I have a last question, does the Filipino birth certificate is fully filled and signed, meaning mariage section and Father section fully filled-in?

I don't know what should be done for UK for the bith certificate, but in France apart the classical Philippines red ribon authentication (NSO, Malacañang and DFA) we need a full authentication by our Embassy in Manila with their stamp and signature on each page (and over these something you don't need: a duty legalized by an court approved translator in French). I hope it's not that complex for you.

I'm surprised that nobody in this forum had the same problem...
