but its worth thinking about where your kids are born..

any phil born child will be British if you are British otherwise than by descent. So it can depend upon where you were born.

If however you "inherited" British Citizenship from your parent(s) but you were born outside the UK, that is you are British by descent, then your children will only be British if born in the UK, but will not be British if born outside the UK.

so a phil-born child is going to be British by descent. That means that their children ... your grandchildren ... will only be British if born in the UK. If born outside the UK then they will not be British.

Compared to ... if the child is born in the UK then they will be British otherwise than by descent ... and thus their children will be British wherever born in the world.
thats well explained joebloggs, thanks for that... we clearly undertand it now. so now i understand why my daughter got a british passport without any problem.
    cheers mate!

You can claim Child Benefit if your child is living here in the UK regardless of whether they were born here or not. My step-daughter was born in Phils and has a visa that say "No Access to Public Funds" but we still claim Child Benefit for her and we also claim Working Tax Credits.

    Iain.
Ok, so it appears some in our situation can get working tax credit.

Now my question is this. Can this be taken into account in a settlement visa application?

In my opinion...if you want your application to 'look good', do not claim any benefits until you get your ILR.

it shouldn't make any difference, your husband is claiming it not you, your applying for ILR not your hubby.

I applied for child benefit and tax creds, no problems at all getting ILR for the wife and kids.

ILR for most people should be straight forward, if you've collected the 20 bits of evidence, done the life in the uk test and your hubby has a job, there should be no problems getting ILR, as the refusal rate is low compared to a spouse/fiancée visa, as you've done most of the hard work already getting the spouse/fiancée visa.
