    uk or philippines

    please can someone tell us where is it best to lodge our appeal in the philippines or in the uk?we have to act fast only 27 days left to appeal.also were talking about getting married in the philipines now frances can't get here will that affect our visa will it be the wrong visa will she need spouse visa ,or if we get the fiancee visa is that ok fo her to come here as my wife on the fianee visa or will we have to reapply for spouse?

    you need to do it in the philippines phillip with in that remaining 27days so that you don't pay again the visa and yeah thats better to get married in th PI i dont think its will affect in your application next time, just need to be careful to fill in the application if have a sort of question regarding to your previous visa application.

    Philippines.

    While the appeal is processing, you can plan a Phil wedding, plenty of info on here. Then when you are both in the UK, you have another 'wedding' at the church for your family.

    when were both in the uk?. but first how do i get her here,can sombody advise us what we do now .do we appeal in the philippines or here in the uk.the reason J Wenlock denied us is because she did not belive the wedding was going to take place as the embassy telephoned the caterer 3 times and was hung up on therefore the document was false.also frances had damaged her credibility by not mentioning me when she applied for a visit visa last year.
    the caterer is a local lady who does this part time she also works part time ,a very small enterprise,and the phone number is her house where she lives with her husband and 2 teenage children.i think the embassy may have been expecting to get through to recption at some hotel i just dont know.its making me ill just trying to think what i have to do next to get my loveone here,can someone advise step by step what i have to do time is running ot fast,from what i can see its going to be a year before we get the result of the appeal,what do you think about just applying again maybe i could use an expencive hotel next time to pre book the recption with no intention of ever using them .
    at out recption it was only going to be my 3 family members and a few close friends say about 20 people,thats why i was using a small caterer.i was going to have to foot the wedding expences myself as my perants are unable to help.so experts here what do i have to do please?

    My friend was been denied when they applied for her visa and they or may I say the brit bf appeal here in the UK. One week after they won over there appeal and been granted for a visa. So, my friend ( a filipina ) is already here. Good luck to you.

    you apply in the philippines so you need to appeal in the philippines that simple,don't be confuse i know what you feel guys.goodluck

    "You can lodge your appeal directly with the Asylum and Immigration Tribunal (AIT) in the UK or you can send your appeal form to the overseas visa section where your visa was refused. The visa section will then forward it to the AIT in the UK. You cannot do both. If you lodge your appeal at the overseas visas section where you were refused, the Entry Clearance Manager will review your case in view of any new evidence that you have supplied with your appeal form. The refusal decision may be overturned at this stage. "

    hahaha benb you beat me to it, but there is only a small chance the embassy will over turn it..

    'In the majority of cases, the Entry Clearance Officer does not overturn the decision, and if s/he is satisfied that the original refusal was correct, then the AIT, will arrange for an independent adjudicator can review the appeal'

    you could appeal to the Asylum and Immigration Tribunal (AIT) in the uk,, the embassy in the phils would send your appeal form to the uk anyway wasting time.

    but if you sent it to the embassy, an Entry Clearance Officer will review the application in the light of your grounds of appeal, and if s/he is satisfied that the requirements of the Immigration Rules have been met, the refusal will be overturned and the visa will be issued, but there is only a small chance of this happening, if you send your appeal directly to the AIT, the Entry Clearance Officer will only review the decision once the papers have been sent to the Visa Section from the AIT.

    maybe you should phone up your local law centre or IAS and get some free advice and guidence

    Oh! I thought that it would be *easier* for the ECO to overturn the decision than the ECO writing a detailed justification and forwarding it to the AIT. Oh well, at least its worth a try. Giving new and good evidence at such short notice may be tricky.

    Has anyone got experience with IAS? are they really useful?

    no, i think your right, kinda like a reconsideration, but as stated on the embassy website, the majority are not overturned by a eco and are sent to the AIT.doesn't mean this app will, if he gets some good evidence and can prove the original decision was wrong, it's always worth try, if they do overturn it at the embassy, it would be quicker than going to AIT or making a new app

    IAS, I tried many times to phone them in the past and emailed 2 of their offices, never got thru to them or a reply . but i've heard they have helped many people out

    the local law centre and the excellent JCWI, i've used in the past.

    One thing is certain if you appeal to to the Embassy in Phil.

    You need evidence to prove you are getting married in the UK.

    One question you need to ask of your caterer is she vat registered and open to full scuritny from the goverment?
    Shes not doing it on the side cash in hand is she?
    If she is all legit you need her to get her headed note paper or complment slips (if she doesn't have any invite her to come to the local print shop (kall kwik or prontaprint sort of place) and ask to get some headed note paper with her name as owner , business addrees and vat number etc. If you get a quote for a small amount it may cost a bit but its that or wait for an appeal or re apply.

    What are the other points that were mentioned in the Letter of turning the Visa down?

    as you need to counter all of them.

    So if either of you can give us the points on which they deny. Im sure we can all help you out.
