If there is anybody out there, that is desperate for help with the violent husband, or even wife, don't worry there is protection available if it is needed.

Do not take abuse lightly, report it immediately.

Home Office rules state that any foreign national whose marriage breaks up within two years because of domestic violence can apply for indefinite leave to remain, but they must have reported the incident at the time to a person in authority - such as a GP or police officer.

This is provided that the Domestic Violence occurred during the probationary period while the relationship was subsisting, and the applicant is able to provide evidence that Domestic Violence has taken placeand caused the relationship to break down permanently. That the relationship was subsisting when Domestic Violence occurred would normally be evidenced by the fact that the couple were living at the same address when the incident took place.

i've read some posts, where the husband has been accused, but swears he is innocent, and his wife just wants out of the marriage but wants to stay in the uk, also there is a risk of someone getting married and trying to get ILR this way without any domestic violence - sham marriages, but i'm sure for everyone of these cases they are many genuine domestic violence cases out there.

sadly so, but like everything its open to abuse.

it's funny how many non Europeans I've read about who are married to Europeans in the uk, who's marriage lasted exactly 3yrs and the last yr of the marriage was spent in the UK, and then they got divorced allowing the non European to stay and live in the UK with their new partner

Shafi had travelled to Ireland in July 2008 on a tourist visa, along with a group of other Pakistanis who claimed to be members of a cricket team.

That Shafi had failed to return home after his visa had expired was not the issue. What drew attention to his case was the fact that almost every member of the cricket team stayed in Ireland and either married Latvian women or applied for permission to do so.


384 Pakistani men had sought residency permits on the grounds that they had married EU citizens, usually eastern Europeans. Of these brides, 116 were Latvian, 50 were Polish, 47 were Estonian and 39 were Lithuanian. Large numbers of Nigerian and Indian men had done the same. Indian men had married 36 Latvian and 28 Polish women.
