yes they should phone BIA, and im 99% sure they will tell them to apply for FLR.

Looking at another post they actually will allow up to 3 months - guess this is since they increased the spouse visa from 24 months to 27 months.

Though as they will put your application on hold it's definitely not worth paying the £200 extra for the same day service (as they won't process it the same day...).
